Terms and Conditions for Academy Course Applicants

Please read the following terms and conditions carefully before applying and making payment for any of the American Offshore Wind Academy's courses:

1. Enrollment:
- By enrolling in our courses, you agree to these terms and conditions.
- You must be at least 18 years old to enroll in any Academy course.

- Submission of false or misleading information in the application may lead to disqualification.

2. Course Materials:

- Course materials provided by the Academy are for personal use and should not be shared or distributed without permission.

- All Academy course materials are protected by copyright and intellectual property laws. You may not use, distribute, or reproduce these materials without written permission from the Academy.

3. Payment:

- Payment for courses can be made either online or through company invoices.

- Invoices generated for corporate payments should be settled within 30 days of your enrollment or before the course date, whichever comes first.

- Access to the course will be denied if payment is not received before the course start date.

4. Cancellation and Refund Policy:
- You are eligible for a full refund if you request cancellation within 24 hours of course enrollment.

- Cancellation requests made after the initial 24-hour period but up to two months before the scheduled course date will be eligible for a 50% refund.

- No refunds will be issued if cancellation occurs less than two months from the course start date.

- If payment is made by a company, refunds will be issued directly to the paying organization.

- Participants who cannot attend their scheduled course may request a transfer to a future session, subject to approval.

5. Code of Conduct:

- All participants are expected to adhere to a code of conduct that fosters a respectful and inclusive learning environment.

- Disruptive behavior or harassment will not be tolerated.

6. Intellectual Property:
   - All Academy course materials are protected by copyright and intellectual property laws.
   - You may not use, distribute, or reproduce these materials without written permission from the Academy.

7. Privacy & Data Protection:

- Participants' personal information will be collected and used for course administration.

- Personal information will not be shared with third parties without consent.

The Academy retains participant records, including enrollment and assessment data, for five years for verification and compliance purposes.

- Participants may request the removal of personal data following Academy policies, except where records must be maintained for legal compliance.

8. Communications:
   - You agree to receive communication from the Academy, including course updates, newsletters, and promotions.
   - You can opt out of promotional communications at any time.

9. Termination:
   - The Academy reserves the right to terminate your enrollment without refund if you violate these terms and conditions.

10. Limitation of Liability:
   - The Academy is not liable for any indirect, special, or consequential damages, whether foreseeable or not.

11. Course Changes:

- The Academy reserves the right to make changes to course schedules, instructors, and content if necessary.

- The Academy may update course schedules, instructors, and content to reflect industry best practices and compliance requirements.

- Participants will be notified of significant changes at least 10 days in advance.

12. Certificates:
- Successful completion of a course will result in the issuance of a certificate.

- Participants must meet the course requirements to receive a certificate, including minimum attendance of 50% and a passing score of at least 50% on assessments.

- Certificates issued by the Academy recognize successful course completion and are not professional licenses or certifications.

- The Academy reserves the right to revoke or invalidate a certificate if it is found that a participant did not meet the program's initial requirements or engaged in academic dishonesty, misrepresentation, or code of conduct violations.

- Employers and other stakeholders may verify certificate authenticity through AOWA’s certificate validation tool.

13. Certificate Use & Misuse:

- Certificates are intended to demonstrate completion of AOWA training programs and may be used for professional development, job applications, and industry recognition.

- Misuse of certificates, such as misrepresentation of skills or falsification, may result in certificate revocation.

- The Academy reserves the right to invalidate certificates found to be misused and notify relevant stakeholders.

14. Complaints & Appeals:

- Participants have the right to submit formal complaints or appeals regarding course assessments or administrative decisions.

- Appeals must be submitted in writing within 15 days of the disputed outcome.

- The Academy will review and respond to complaints within 30 days.

15. Limitation of Liability

- The Academy is not liable for any indirect, special, or consequential damages, whether foreseeable or not.

- The American Offshore Wind Academy certificate programs are educational in nature and do not constitute licensure, ANSI certification, or professional qualification in any jurisdiction.

16. Changes to Terms and Conditions

The Academy may update these terms and conditions at any time, and you will be bound by the revised terms.

17. Governing Law

These terms and conditions are governed by the laws of the Commonwealth of Massachusetts in which the Academy is based.

Please note that the American Offshore Wind Academy reserves the right to make amendments to this policy at its discretion. Applicants and participants will be notified of any changes made to these terms and conditions. We appreciate your understanding and cooperation.
